Terms & Conditions of Business

 

 1. DEFINITIONS

           ‘The Accston Trading Company’, ‘Accston’ or ‘the company’ means Accston, 25 Milnshaw Lane, Accrington, Lancashire. BB5 1AY United Kingdom. Telephone : 0845 094 2396 e-mail : post@accstontrading.co.uk website : www.accstontrading.co.uk

           ‘Client’ or ‘customer’ means any individual, company, partnership, organisation or other body who instructs the company to provide any products or services.              

          Placing an order with the company constitutes full agreement with and acceptance of these terms and conditions.

          This agreement shall apply to any and all services or products ordered by a client from the company.

          The Accston Trading Company is a private company owned and operated by Mr Andrew Hall.
 

2. PRICES & PAYMENTS

          All prices are quoted in £ sterling, including any applicable UK taxes. The prices shown are per item unless otherwise stated. Please note that any Euro or Dollar prices quoted are a guide only. The current exchange rate will be applied to Euro and Dollar orders at the time the order is accepted. We reserve the right to change our prices at any time. In addition we reserve the right to refuse to sell any item listed without reason.

          Any invoice queries must be notified to the company in writing within 3 working days of receipt of the invoice, either by post or by e-mail.

          The company reserve the right to charge interest on any overdue amounts at 8% above the prevailing Bank of England base lending rate calculated on a daily basis until the amount is paid in full including such interest accrued.  Accston also reserve the right to recover from the client any costs associated with debt collection and recovery including reasonable administration fees.

          The company will record details of any overdue amounts and use this information to assess the continued provision of service to a client. This information may also be reported to a credit reference agency.

          All goods remain the property of The Accston Trading Company until paid for in full. Payments can be made via any of the available methods on the website. Our online payment partner, PayPal uses secure sites and details of your payment card are not made available to us. Goods will only be dispatched on receipt of cleared funds.

          The Accston Trading Company do not offer credit facilities.  Where payment is made by cheque and the cheque is subsequently returned unpaid by your bank or building society, your order will be cancelled and a £35:00 administration fee will be charged. Cheques and postal orders should be made payable to “Accston”.


3. STOCK AVAILABILITY

          Our aim is to be in stock of all items all of the time. Inevitably however, at times an item may be out of stock. If this occurs, we can usually back order items for you. You will always be emailed with the options of back ordering, changing your order to something similar, or to cancel your order with a full refund if you would rather not wait.
 

4. ORDERING, DISPATCH & DELIVERY

          When an order is placed via our website, we will usually acknowledge receipt of this via an e-mail. We do not however enter a contract with you until we accept your order. This is done when your goods are dispatched. You will be notified of this by e-mail when dispatch has occurred.

          Your order will be dispatched as soon as possible following receipt of cleared funds. Whilst every effort will be made to honour any delivery dates, these should be treated as an estimate only.  We cannot accept any liability for any failure to deliver within these estimated times.

          Your order may be split into a number of separate parcels in order to speed up delivery. If this happens the postage and packing fee charged will remain as originally notified.

          No goods or services shall be supplied by Accston on a trial basis.

          Accston do not warrant the suitability of any goods or services supplied.  It is the clients’ responsibility to ensure that goods or services are fit for the proposed use prior to ordering.

          In the unlikely event that Accston cannot supply goods or services ordered by the client, we reserve the right to offer goods or services of an equal or superior quality. If these goods subsequently turn out to be un-acceptable to you and need to be returned to us for this reason, we will reimburse reasonable return postage costs.

          The company will accept no liability for shortages or damage to goods or services unless these are notified in writing to the company by the client within three working days of receipt of the goods.

          If for any reason the customer is unable to accept delivery of any goods ordered at the time when they are due and ready for delivery, and the goods are subsequently returned to us, a £10:00 administration charge will be levied. Further arrangements for delivery will only be made when any outstanding costs or other amounts have been fully paid and then at the sole additional expense of the customer. The date of the original invoice raised will not be amended.


5. CANCELLATIONS & RETURNS

            Customer Cancellations

          Customers placing an order via our website or from one of our ‘auction style’ website listings, will be entitled to cancel their order for any reason, at any time from the date of placing the original order, up to seven days following delivery of their goods.

          A full refund of the purchase price of the goods (not including postage and packing charges if items have been dispatched) will be given provided the goods have not yet been dispatched, or are received back by Accston within seven days of the customer informing us of the decision to cancel the order.

          Goods must be posted back to us at the customers’ expense and must be received in original condition with all parts, tags and paperwork etc. complete. PLEASE NOTE that proof of posting is not proof of delivery and you are advised to use a trackable and suitably insured postage method. We cannot be held responsible for any damage or losses during the return and cannot refund for items we do not receive, or which we receive back damaged. However, if you use such a postage method, compensation for lost or damaged items should be claimable from your postal company.

           Damaged, Faulty or Missing Goods

           We aim to give 100% satisfaction. If any part of your order is delivered damaged, faulty or has items missing, then, provided we are notified in writing (by e-mail or post) within 24 hours of you receiving the delivery, we may, at our option remedy any shortage or non-delivery or replace or rectify any damaged or faulty items which you have received. Alternatively we may refund the purchase price of the relevant goods. If you are asked to return any faulty or damaged goods to us then reasonable postage costs will also be refunded. The procedure for returning such goods will be fully explained once we are notified of such an occurrence.

           No claim will be entertained in respect of any goods which have been tampered with or altered in any way or have been subjected to any accident or damage howsoever caused by the client, its employees or agents, or through any use contrary to the manufacturers instructions.  In addition, claims cannot be entertained for goods which cannot be shown to have been supplied by the company.
 
    

6. PRIVACY STATEMENT

          The Accston Trading Company recognises that online privacy is very important. To this end, our website does not collect any personally identifiable information automatically.  Nor is this information available to us whilst you are browsing the site. If you choose to submit such information at any time, as a result of completing an online form within the site, or sending an e-mail etc., your e-mail address will be kept securely and will not be made available to anyone else except in accordance with the Law. All information is collected, stored and used in accordance with the Data Protection Act 1998.

          The Accston Trading Company do not sell, publish or otherwise disseminate e-mail address lists to any third party. We may occasionally use details you supply to notify you of special offers, discounts or other information which we feel may be of interest to you. Any such correspondence will be kept to a minimum and will not usually occur more than once per month. (See cancellation below.)

          If we contact you or you choose to subscribe to any mailing list etc. from within the site, you shall at all times have the right to terminate your subscription and to receive no further mailings from us.  All such requests will be dealt with as soon as is practicably possible. Any mailing, which we do send to you, will have full details (or a link to such details) of how to cancel your subscription at the end of the document.

            You can ask to see a copy of any information we hold about you by sending us an e-mail requesting this. All information is as up to date as possible, but if there are any inaccuracies, we will amend or delete this as soon as possible once you let us know.

7. COMPLAINTS

            All of The Accston Trading Companies staff are extremely well trained and hopefully your interaction with us will be straightforward and enjoyable. However, we realise that there may be occasions when things do go wrong and we encourage all customers to let us know if this happens. Any complaints, or suggestions for improvement should be made either verbally, by e-mail or in writing by traditional mail to the customer service manager at the address below.

            Once your complaint is received, we will acknowledge receipt of it within 5 working days and, following investigation, let you know the outcome within 10 working days of that. If at that stage you are still dissatisfied, you can then refer the matter to the proprietor, who will again investigate and let you know the outcome within 15 working days. At this stage, the proprietors decision is final. This does not affect your statutory rights.

8. LIABILITY

                   The company shall under no circumstances be liable for any clients’ loss whether direct, indirect or consequential howsoever caused.
 

 9. FORCE MAJEURE

                   In the event that Accston is prevented from carrying out its obligations under a contract with a client as a result of any cause beyond its control such as, but not limited to Acts of God, War, Strikes, Lock outs, Flood, Failure of third parties etc., Accston will be relieved of its obligations under such contract for as long as such fulfilment is prevented.


10. MISCELLANEOUS

                Replica Tin Toys

                To the fullest extent as set down by the law, The Accston Trading Company provides the warning information on all products that require them. With the Replica tin toys the safety legislation states that due to the item containing small and sharp parts the item must only be sold to ADULT collectors. Under no circumstances may they be sold to a child or sold to an adult who has the intention of providing it to a child. When this product is ordered and the confirmation email is sent you accept this products terms and conditions. Further to this a warning notice will be provided with the order which must be displayed with the product.

          These terms and conditions do not affect and are in addition to your statutory rights.

          No members of Accston staff have the authority to alter any of these terms & conditions.

          If any part of this document is held to be illegal, invalid or unenforceable, the validity of the remaining provisions shall not be affected in any way.

          Waiver of any of these terms and conditions by the company for a client shall in no way affect the rights of the company in any way.

          Any notice or demand issued by the company to a client will be given in writing and delivered to the last known address of the client by first class mail and shall be deemed to have been served forty eight hours after posting.

          The Laws of England shall govern any contract between the company and any client to which these terms and conditions apply.  The parties therein shall submit to the jurisdiction of the English Courts.

          These terms and conditions are effective as from September 6th 2008 and replace any and all previous versions of the same. E&OE.
